Terms of Use

The Marine Corps Association owns and operates multiple web properties: the Association’s main site www.mca-marines.org; the Association’s ecommerce site www.marineshop.net; the award-winning Leatherneck Magazine www.mca-marines.org/leatherneck; and the professional journal, Marine Corps Gazette www.mca-marines.org/gazette.   

The Marine Corps Association (MCA) reserves the right to change or modify any of the terms of use (TOU) detailed below for any reason, and any such modification or change will be effective immediately.
NO content contained within any of the aforementioned MCA web properties may be copied, saved, distributed or used in any manner without the express permission of the copyright or trademark owner (MCA), or as otherwise permitted by the copyright fair use exception or other applicable law.

1. Content

a. All content provided by MCA (newsletters, databases, articles, etc.) is protected by copyrights and, in some cases, trademarks. Some content may be provided by third parties, whose copyrights or permissions were obtained by MCA for distribution to its Users or were in the public domain.

b. User content includes any content provided by the general membership (conversations and exchanges in comments on articles, blogs, postings on message boards, etc), and the copyright may be retained by the providing user. With respect to any content you provide, you automatically: grant to MCA a royalty-free, perpetual, world-wide, irrevocable license to use, copy, create derivative works based on, and redistribute the content you provide; warrant that you have all rights necessary in the materials you submit to MCA to grant the foregoing license and that the use of all such material by MCA and its Users will not infringe on any other party's rights; and you agree to indemnify and hold MCA and its Users harmless from any claims or damages arising as a result of your use of the site or the content you provide, including but not limited to attorneys' fees.

c. You may not provide, or encourage others to provide, any content which: violates or infringes on the trademark, copyright, privacy, publicity, or other rights of any other party;
is unlawful, defamatory, harassing, abusive, threatening, or obscene; contains any injurious instruction; or is considered ‘classified’ and/or ‘secret’ or any other content that requires special security clearance to obtain. In addition to a prohibition on posting classified information, no material may be posted on any board or forum that violates U. S. Department of Defense or subordinate armed services operational security and could potentially put Marines in  jeopardy.

 d.  Articles that appear on our sites from our magazines Leatherneck and Marine Corps Gazette may be shared as long as they are done so with the acknowledgement that either Leatherneck, or Marine Corps Gazette, as appopriate, retains the copyright and they are cited as the material source.

 

2. Conduct

a. Your conduct on the site not only reflects upon your person, but also on the overall level of professionalism throughout the entire organization, including that of your fellow Users. MCA is a respected association, and its Users are primarily made up of current and retired Marines and others in and around the Marine Corps who participate in order to share information, grow professionally and to promote a stronger sense of ‘esprit de corps’ in  the Corps of Marines.

b. You may not transmit or solicit others to transmit information, or engage in any behavior, that violates any state, local, international, or Federal laws.

c. You may not harass, defame, disparage, threaten, or cause or direct unwanted or uncomfortable attention upon another User or other person.
d. You may not sell, lease, license, or use any information about other Users for commercial or political purposes.

e. Forums/Comments may be used only for their intended purposes. From time to time MCA monitors or reviews discussions, comments, postings, transmissions, and other user and member generated pages on the site, but is under no obligation to do so. We reserve the right, in our sole discretion, to edit, refuse to post or remove any material submitted to or posted on the bulletin boards or on any other user or member generated pages, and to suspend, ban, or terminate the account of any user.  Our failure to exercise that right does not in any way constitute a waiver of that right, or endorsement or approval of any member-generated material. You may not use any message board to advertise, promote or solicit others to advertise or promote any service, product, organization, periodical, or association.

f. You may not impersonate another User, MCA employee, moderator, host, nor in any way present yourself as any person other than yourself.

g. You may not transmit or encourage others to transmit information about yourself, another person, or any product, service, organization, association, or periodical that to your knowledge is false, inaccurate, outdated, or misleading.

h. You may not transmit, encourage others to transmit, disclose, use for commercial, political, or other purpose, or engage in any action intended to procure confidential information from or about other Users or MCA employees.

 

3. Privacy and Usage of Listings by MCA

User’s contact, log-in and other information is held by MCA for internal purposes only, and will not be sold to any third party, for any reason. However, we may be required by law to share information through lawful requests (such as court orders and/or subpoenas) from lawyers, courts or other government agencies. MCA may also need to share user information to prevent fraud, imminent harm or protect against other illegal activities.

When you register with MCA, we collect some personal information such as name, email  address and other information that you provide to us. Further, through your general use of the site, we also collect session data (ie. which pages you visited, Forum messages you read and posted) and may set a cookie on your computer that tracks each session in order to recall what you have previously customized for your log-in.

Forum posts, videos, graphics and other files that you share in public areas are accessible by the entire MCA community, therefore the information you share in such instances are at your own risk.

4. Access

a. You are responsible for your own access to the Internet, through any access provider you choose.
b. You are responsible for all hardware, software, telephone or other connections,
and charges or fees for accessing the Internet.
c. MCA will use reasonable efforts to provide continuous and easily accessible access to the MCA website. As MCA is provided on the Internet, conditions may arise that adversely affect your ability to access the website that are beyond the control of MCA. MCA does not guarantee the dependability or availability of any third party product or service.

5. Spam

You may not use MCA to gather listings of email addresses of MCA Users for the purpose of spamming, or sending any other unsolicited email(s) for advertisements and/or marketing.

6. Feeds and Linking

MCA allows the User to use RSS (real simple syndication) feeds for the purposes of linking to the information on the MCA website. User agrees not to post other User information for any purpose, unless they receive written permission. User also agrees not to use any other information, pages or listings on MCA for any purpose but their own personal use.

7. Copyrights

User retains all copyrights to their personal information, and warrants that they have that right. Any abuses of copyrights should be made known to MCA by emailing legal@mca-marines.org.

8. Indemnification

User agrees to hold harmless, defend and indemnify MCA from all liabilities and claims, including legal and other expenses that arise from Users breach of this agreement, violation of law, or other wrongful conduct.
In case of any abuse, copyright infringement or other illegal or inappropriate activity, you can contact MCA by emailing legal(at)mca-marines.org. We will make all best and reasonable efforts to respond to all queries and reports of abuse in a timely manner.

9. General Information

This TOU constitutes the full agreement between User and MCA. The relationship between the User and MCA is governed by the Laws of the State of Virginia.

10. DISCLAIMERS

THE MCA WEBSITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" BASIS. MCA DOES NOT WARRANT THE ACCURACY, COMPLETENESS, RELIABILITY, AUTHORITY, USEFULNESS, TIMELINESS, OR NON-INFRINGEMENT OF THE CONTENT PROVIDED BY ITS USERS.
MCA, ITS OFFICERS, PARTNERS, EMPLOYEES, AND DIRECTORS SHALL NOT BE HELD LIABLE FOR ANY DECISION MADE OR ACTION TAKEN BY YOU FOR YOUR USE OF OR DEPENDENCE ON ANY INFORMATION OR SERVICES PROVIDED WITHIN THE WEBSITE, NOR FOR ANY CONSEQUENTIAL, SPECIAL, OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
MCA DOES NOT IN ANY WAY GUARANTEE OR ENDORSE ANY OTHER THIRD PARTY INFORMATION OR CONTENT PROVIDER, SPONSOR OR ADVERTISER, UNLESS SPECIFICALLY NOTED.
